General terms and conditions

Albelys — Philip Guelat ("we", "Albelys") operates an online shop at albelys.ch. These terms apply to every contract between us and a customer ("you"), in the version in force at the time of the order. "Consumer" means a natural person entering the contract for purposes outside their trade or profession. "Business customer" means anyone acting in the course of a trade or profession.

Our product pages are an invitation to order, not a binding offer. You place a binding offer by completing the checkout: selecting the device, adding it to the bag, reviewing the bag, entering your delivery and payment details, and confirming the order. We accept your offer by sending an order confirmation by email, or by dispatching the device — whichever happens first. Until then no contract exists. We store the contract text and send it to you with the confirmation.

The Albelys Mask is a cosmetic skincare device. It is not a medical device: it is not intended to diagnose, treat, cure or prevent any disease or condition. The essential characteristics — wavelengths, irradiance, dose per session, session lengths, materials, dimensions and contents of the box — are set out on the product page and in the Safety and usage page, which form part of the contract. Irradiance figures published before our own laboratory measurement are the manufacturer's and are marked as such.

Prices are in Swiss francs and are final prices for consumers. Swiss VAT is included where we are liable for it. Delivery within Switzerland is free; there is no minimum order value and no surcharge at checkout. We deliver to addresses in Switzerland only. Estimated delivery is 3–5 working days from order. These are estimates, not guaranteed dates; where a delay arises we will tell you and give a revised estimate.

Payment is due at checkout, by the methods offered there. Payment is processed by Stripe; we never receive or store your card details. The device remains our property until the purchase price has been paid in full.

You may return an unopened device with its hygiene seal intact within fourteen days of delivery for a full refund of the purchase price. Notify us by email within that period; return postage is at your cost. Because the mask is worn against the face, a device whose hygiene seal has been broken cannot be returned for change of mind. This is a voluntary right we grant; it does not limit your statutory rights in respect of defective goods. See the Returns and Withdrawal pages.

The statutory warranty for defects under Art. 197 ff. of the Swiss Code of Obligations applies, for two years from delivery. In addition, and voluntarily, we replace a device that fails through a manufacturing defect at our cost, including postage both ways. Report the defect promptly after discovering it, with a short description and if possible a photograph or video. Normal wear of the silicone, damage from misuse or improper cleaning, and battery capacity loss after roughly 500 charge cycles are not defects.

We are liable without limitation for damage caused intentionally or through gross negligence, and for injury to life, body or health. For slight negligence we are liable only where an obligation essential to the purpose of the contract is breached, and then only for the foreseeable damage typical of such a contract. Any further liability is excluded to the extent Swiss law permits. This does not affect liability under the Swiss Product Liability Act.

The contract may be concluded in English, German or French. Where versions differ in meaning, the German version prevails for contracts governed by Swiss law.

Swiss substantive law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction is Biel, canton of Bern, Switzerland. Mandatory consumer-protection provisions at a consumer's place of residence remain reserved. We are not obliged to participate in dispute-resolution proceedings before a consumer arbitration body, and we prefer to settle matters directly — write to us first and we will try to resolve it.
